Life Spine Secures Federal Court Order Permanently Prohibiting Marketing or Sale of AccelFix-XT Devices in the United States

HUNTLEY, Ill.--(BUSINESS WIRE)--On December 21, 2023, Life Spine settled its litigation against Aegis Spine, Inc, whereby the parties have agreed to an order issued by the United States District Court, Northern District of Illinois, permanently prohibiting the marketing or sale of the AccelFix-XT line of medical devices in the United States. The order prevents Aegis Spine and any business entities and/or persons controlled directly or indirectly by Aegis Spine, and any business entities and/or persons in active concert or participation with Aegis Spine from, among other things, “Developing, manufacturing, marketing, promoting, advertising, distributing, transferring, assigning, sharing, disclosing, selling, offering for sale, seeking hospital registration of, or submitting a response to a request for proposal for any items in the AccelFix-XT line of medical devices.” In addition, L&K Biomed and L&K Spine have committed to never sell or directly or indirectly cause to be sold the AccelFix-XT line of medical devices within the United States.

Life Spine sued Aegis Spine for breach of contract and trade secret theft shortly after the launch the AccelFix-XT line of medical devices. The United States District Court, Northern District of Illinois, entered a preliminary injunction preventing the marketing and sale of the AccelFix-XT line of medical devices on March 15, 2021. The Seventh Circuit Court of Appeals subsequently affirmed entry of the preliminary injunction. The United States District Court, Northern District of Illinois, entered a permanent injunction on December 21, 2023. The case is Life Spine v. Aegis Spine, Civil Action No. 1:19-cv-7092 (N.D. Ill.).
