Lawsuit Filed by FeganScott on Behalf of E-Bike Owners Against Rad Power Bikes Over Alleged Defective Design that Poses Serious Safety Risks

SEATTLE--(BUSINESS WIRE)--Today FeganScott filed a class action lawsuit on behalf of consumers against Rad Power Bikes claiming the popular electric bike manufacturer sold thousands of e-bikes with a faulty design that puts riders and passengers at risk of serious injury.

The lawsuit focuses on the faulty design of the e-bikes based on the bikes’ heavy weight, fork design and quick release parts. The lawsuit alleges that the defective design can cause the front wheel to disengage from the bike frame while in operation, leading to increased instability, wobbling and even complete dismantling of the bike, sending riders into high-speed crashes.

Most concerning about the faulty design, the e-bikes are marketed to be able to meet speeds of 20 miles per hour or more, making it critical that the manufacturer warn consumers immediately of the bikes’ risks and provide a comprehensive remedy to prevent catastrophic accidents.

According to Elizabeth Fegan, managing partner of FeganScott, Rad Power Bikes knew about the defective design for years, but continued to develop and sell its e-bike products.

“As e-bikes grew in popularity, Rad Power Bikes put profit over the safety of its riders, marketing e-bikes as a ‘safe, family-friendly’ mode of transportation,” said Fegan. “For our lead plaintiff, what should’ve been a routine ride to the grocery story ended at the hospital, where he was treated for five broken ribs and a broken clavicle following a crash on his e-bike after the loss of its front wheel.”

According to the lawsuit, Rad Power Bikes, founded in 2007, has grown at a rapid rate, reaching a ridership of more than 500,000 by 2022.

“Rad has touted it has an e-bike model for everyone, including outdoor adventurers, city commuters, and even families, all while knowing that these products could cause major accidents that result in serious injury,” Fegan added. “Through this suit, we intend to hold Rad accountable for blatantly ignoring its responsibility to protect its consumers, putting their lives, and the lives of others, at risk.”
