Marin County School Overcomes Failed Facilities Upgrades

WALNUT CREEK, Calif.--(BUSINESS WIRE)--With the help of Berding & Weil - Attorneys at Law, a Marin County school now has safe and functional buildings, and a useable playing field. Through a combination of successful litigation resulting in a significant monetary recovery, along with negotiated in-kind remuneration from facility design professionals, contractors and materials suppliers, the construction defect firm was able to obtain the compensation necessary to correct major design and construction deficiencies. The failed facility upgrades resulted in serious water damage, mold infestation in classrooms and a flooded athletic field. These problems were largely the result of faulty work on the part of the general contractor and subcontractors hired to facilitate and perform capital improvements as part of an important school expansion project.

Only a few months later, with litigation ongoing, it was discovered that the school’s new large playing field was installed with improper drainage and the wrong soils mix. During times of even moderate rain, the field would become saturated and unsuitable for its intended purpose for weeks at a time. During heavy rain, the runoff threatened to enter classrooms and sandbags became a semi-permanent fixture at the school.

Thomas said the field was repaired by negotiating significant contributions from multiple design professionals, contractors and materials suppliers, without the school needing to file suit.
