Cotchett, Pitre & McCarthy Announces Opening of $250 Million Apple AI False Advertising Settlement Claims Period

SAN JOSE, Calif.--(BUSINESS WIRE)--Cotchett, Pitre & McCarthy announced today the beginning of the 90-day Notice Period during which Class Members can submit their claims in this landmark settlement. On July 17, 2026, Judge Noël Wise of the U.S. District Court for the Northern District of California granted preliminary approval of this $250,000,000 Settlement with Apple in this nationwide false advertising class action concerning “Apple Intelligence” on iPhones. Plaintiffs allege that Apple saturated the market with advertising presenting the iPhone 16, and certain models of the iPhone 15, as a breakthrough in artificial intelligence. According to the complaint, the centerpiece of this marketing campaign was a dramatically enhanced AI-powered Siri personal assistant that could integrate information across apps. As alleged, tens of millions of consumers purchased iPhones based on these ads; however, Apple failed to deliver the promised features.

Under the $250 million Settlement, U.S. consumers and businesses who purchased an eligible iPhone from June 10, 2024 to March 29, 2025, and submit a valid claim, will be entitled to a cash payment for each device. In agreeing to the Settlement, Apple does not admit to liability and denies having engaged in any wrongdoing.

The district court appointed Cotchett Pitre & McCarthy, Kaplan Fox and Clarkson as Class Counsel and approved a robust Notice Plan to go out to class members from September 21 through December 21, 2026 via email, U.S. mail, news publications, and an innovative online media campaign. The deadline for class members to submit a claim is December 21, 2026. The case is Landsheft v. Apple Inc., 5:25-cv-02668-NW, in the U.S. District Court for the Northern District of California.
