Dallas Appeals Court Decision Protects Integrity of Trial Agreements

Johnston Tobey Baruch's Chad Baruch secures appellate victory reinforcing the binding nature of trial stipulations

DALLAS--(BUSINESS WIRE)--The Fifth Court of Appeals in Dallas has affirmed a trial court judgment secured by Johnston Tobey Baruch partner Chad Baruch, issuing an opinion that reinforces the binding nature of trial stipulations and provides important guidance for Texas trial and appellate practice.

The opinion provides important guidance for litigants and trial courts by confirming that parties who agree to narrow the issues for trial cannot later revive excluded arguments on appeal.

The underlying dispute arose from a settlement agreement involving a commercial real estate matter. After a bench trial, the trial court ordered specific performance, requiring the defendant to convey the property under the terms of the agreement. On appeal, the defendant argued the judgment should be reversed based on issues that were not included in the parties' trial stipulation.

The case is Khodaparast v. Kumar, No. 05-25-01034-CV, in the 5th Court of Appeals of Texas at Dallas.

The decision adds to Mr. Baruch's growing body of appellate work. In recent months, he successfully defended a jury verdict in a homeowners insurance coverage dispute, obtaining an opinion clarifying the treatment of deductibles and attorneys' fees.
