Amini LLC Secures $2.2 Million Attorneys’ Fees Award in Fiduciary Breach Case
NEW YORK--(BUSINESS WIRE)--Amini LLC announces another victory before Justice Joel M. Cohen in New York County’s Commercial Division, awarding our client $2.2 million for the legal fees and costs she incurred in successfully litigating her claims against her husband’s longtime business partner. The amount awarded represents the entire amount the client had sought. This follows a significant ruling securing a multi-million-dollar judgment in favor of our client for monies unlawfully misappropriated by the defendant.
The case, led by Amini LLC partner Bijan Amini and associate Charles Wollman, centered on a complex dispute between our client Jane Greenman, the executrix of the estate of her late husband, Charles Greenman, and Larry Miller, a longtime friend and business partner of Mr. Greenman. After Mr. Greenman’s untimely death, Mr. Miller took over management of jointly owned companies, which precipitated a significant breakdown in both the personal and business relationships between Mr. Miller and Mrs. Greenman.
A seven-day bench trial earlier in the case exposed the complicated dissolutions involved. Justice Cohen’s 60-page post-trial decision identified several breaches of fiduciary duties by Mr. Miller, including personal enrichment at their companies’ expense and the misappropriation of millions of dollars from company funds. The judgment mandated Mr. Miller to repay misappropriated funds and release Mrs. Greenman’s share of liquid assets, which were found to have been unjustly retained.
