NAM Introduces a Customized Fee Structure for Mass Arbitration Filings in the Employment and Consumer ADR Arenas

NEW YORK--()--NAM (National Arbitration and Mediation), one of the nation’s leading providers of Alternative Dispute Resolution (ADR) services, is pleased to announce that we have created a customized fee structure to address issues that have arisen as a result of mass filings of arbitration demands in the Employment and Consumer arenas.

In the wake of several recent high-profile arbitrations, the subject of mass arbitration filings continues to draw significant attention and media coverage. When large groups of claimants (i.e., consumers or employees) file arbitration demands pursuant to mandatory Employment and/or Consumer arbitration provisions in their underlying contractual agreements, the resulting filing fees can be substantial and create challenges for all parties involved in the dispute resolution process.

With this industry challenge in mind, and after receiving feedback from both the claimants and defense bars in these types of matters, NAM has developed a fee structure that enables the arbitration proceeding to move forward without the fees becoming an impediment to the administration of the arbitration.

Key elements of NAM’s unique proposition include the following:

  • Applicability of NAM’s Mass Filing program is defined by clear and objective criteria, avoiding the need for subjective decisions that could be seen as partial to one party;
  • Use of Employment and Consumer procedural rules that are known, trusted and time-tested, and which do not create procedural delays that could be challenged as biased;
  • Modified filing fees to reduce the upfront financial burden on all parties; and
  • Significantly reduced fee structure that is billed over time and commensurate with the occurrence of specific administrative events (i.e., panel preparation, scheduling of the hearing) and payable only if the matter reaches that phase of the administration.
