Collin County Jury Awards Texas Man $6.2 Million Over Botched Spinal Surgery

FORT WORTH, Texas--(BUSINESS WIRE)--The Law Offices of Laird & McCloskey has secured a $6.2 million jury verdict in Collin County on behalf of a Texas man who was left a paraplegic following a botched spinal surgery.

Jurors in the 380th District Court ruled in favor of Lamar County resident Bill Proctor, who suffered permanent neurological damage at the age of 57 as a result of elective lumbar spinal surgery in 2018. The verdict is believed to be the largest medical negligence award in Collin County history.

On the advice of a neurosurgeon, Mr. Proctor underwent surgery to alleviate chronic lower back pain. The lawsuit details evidence that during the surgery, Dr. Mark Viktor Silver overly stretched or compressed the nerves affecting mobility, permanently impairing the functions of Mr. Proctor’s bowels and bladder.

Additionally, according to the lawsuit, the surgical team with Advanced Intra-Operative Monitoring Specialists failed to properly perform neuromonitoring procedures to detect and communicate changes in nerve conduction in real time so the surgeon could take corrective action and avoid permanent injury to the patient.

Mr. Proctor was represented by managing partners Seth McCloskey and Steven C. Laird in the lawsuit.

After a week-long trial, jurors found Dr. Silver 60% responsible for Mr. Proctor’s injuries, which under Texas law resulted in him being held accountable for all damages.
