Millions of Americans will soon have to show their vaccination status to their employers. Last week, OSHA released its Emergency Testing Standard (ETS), requiring private companies with 100 or more employees to create, implement and enforce a policy regarding COVID-19 vaccination or testing. That goes into effect on January 4, 2022, but many of the aspects of ETS go into effect on December 5, 2021. The US Department of Health & Human Services (HHS) also issued an interim rule (“CMS rule”) for mandatory vaccination requirements for healthcare workers in facilities that participate in Medicare and Medicaid programs.
