ZOLL Defeats Claims by AutoMedx, Awarded Damages and Attorneys’ Fees

CHELMSFORD, Mass.--()--ZOLL® Medical Corporation, an Asahi Kasei Group Company that manufactures medical devices and related software solutions, announced today that it was awarded $1.8 million in damages plus $3.6 million in attorneys’ fees, costs and interest for breach of contract by AutoMedx, LLC. The arbitrator also denied all of AutoMedx’s claims against ZOLL and its subsidiary, Advanced Circulatory Systems Inc. (ACSI).

The dispute arose from ACSI’s termination of a product development agreement due to AutoMedx’s failure to perform. In response to the termination, AutoMedx sued ZOLL and ACSI in federal court, seeking in excess of $50 million in damages. As required by contract and as a result of ZOLL’s motions, all of the claims in that case were sent to arbitration.

“We are pleased that the arbitrator found ACSI’s termination of the AutoMedx contract to have been proper and that ACSI was entitled to a refund from AutoMedx of its development costs, as well as an award of a substantial amount of the attorneys’ fees and costs that ZOLL incurred in the arbitration” said Jonathan A. Rennert, Chief Executive Officer of ZOLL. “It is unfortunate that AutoMedx chose to pursue litigation, as the arbitrator completely exonerated ZOLL and ACSI from any liability to AutoMedx whatsoever.”
