HOUSTON--(BUSINESS WIRE)--City Cellars HTX, a small business serving the LGBTQ+ and African American communities, has filed a lawsuit in response to an unwarranted eviction notice from their landlord, Balcor Parc Binz I, LLC. Daniel Wolfe, the owner of City Cellars HTX, is seeking a declaration that the eviction notice is both ineffectual and unenforceable. The notice was issued despite Wolfe being fully compliant with all lease obligations, including timely rent payments.
Robert N. LeMay of Kane, Russell, Coleman and Logan is representing City Cellars HTX in the case, which seeks to have the lease declared fully in effect, allowing Wolfe to continue serving the community for years to come. The law firm asserts that the attempted lease termination is based on alleged technical defaults that either never occurred or do not allow termination under the specific terms of the lease agreement.
“Not only is this request completely unwarranted and opinionated, but it’s also catastrophic to my business and the communities I serve,” says Wolfe. Wolfe has been a pillar of the community for years and has received numerous accolades for his community contributions, including being named a "Hometown Hero" and receiving a proclamation from the Mayor. Since launching in 2020, Wolfe has overcome many obstacles, including a cancer diagnosis and the pandemic, only to face an unwarranted eviction notice from his landlord.
