SiebenCarey and Newmark Storms Dworak File Federal Lawsuit Following Overdose Death of Patient at Hazelden

Hazelden Betty Ford Foundation and Dr. Janice D. Tandler Named in Medical Malpractice Lawsuit Venued in Federal Court

MINNEAPOLIS--()--SiebenCarey and Newmark Storms Dworak today filed a federal medical malpractice lawsuit in United States District Court, District of Minnesota, against Hazelden Betty Ford Foundation and Dr. Janice D. Tandler. The legal filing comes after the October 27, 2017 overdose death of Riley Weinkauf, who was receiving treatment at Hazelden’s Center City, Minn., location.

Riley Weinkauf was a 28-year-old man, who sustained an overdose and died while admitted to inpatient chemical dependency treatment at the Hazelden Betty Ford Foundation. Riley was admitted to Hazelden on October 20, 2017 and died on October 27, 2017.

While Riley had serious challenges that he was attempting to overcome, it was generally understood that Hazelden was one of the most respected treatment centers in the world, and his family was hopeful that Riley would receive the best possible care for his struggles. However, when it came to Riley's care, the lawsuit alleges that Hazelden and its staff fell far below its reputation and the medical standard of care. The purpose of this lawsuit is to further uncover and obtain accountability for these failures, and to ensure no family endures the heartbreak the Weinkauf’s have experienced.

“A family should trust that their loved ones will receive outstanding care at Hazelden, but Riley did not,” said Jeffrey Montpetit, attorney at SiebenCarey. “Riley’s death at Hazelden was entirely avoidable,” added Jeffrey Storms, attorney at Newmark Storms Dworak.
