Cyclospora Lawsuit Filed against Kwik Trip in Wisconsin by Attorneys Lindsay Lien Rinholen and Ryan Osterholm

EAU CLAIRE, Wis.--()--Attorneys Lindsay Lien Rinholen and Ryan Osterholm filed a Cyclospora lawsuit today against Kwik Trip and Del Monte Fresh Produce, N.A. The lawsuit was filed on behalf of Averie G., who allegedly contracted a Cyclospora infection after eating vegetables from a Del Monte vegetable tray sold at the Kwik Trip located at 4395 North Hall Road, Eau Claire, Wisconsin in May of 2018.

The suit was filed in Wisconsin Circuit Court, Eau Claire County (Case no. 2018CV000283). It seeks compensation for pain and suffering, medical expenses, lost wages, and other damages.

According to documents filed with the court, plaintiff Averie G. purchased multiple Del Monte vegetable trays from the Kwik Trip located at 4395 North Town Hall Road, Eau Claire, Wisconsin, from May 14 through May 29, 2018. On or about May 30, 2018, Plaintiff began suffering symptoms of a Cyclospora infection, also referred to as cyclosporiasis. She sought medical care on June 8, 2018, and was diagnosed with a Cyclospora infection on June 9. She continues to suffer symptoms and fatigue from her illness.

“This is the first of many lawsuits we are preparing to file on behalf of people sickened in this outbreak in Wisconsin and Minnesota,” said lawyer Osterholm.

The Wisconsin Department of Health Services (WDHS) informed the public of the outbreak on June 8, 2018. At that time WDHS warned consumers not to consume the following products: “Del Monte Vegetable Tray (containing broccoli, cauliflower, carrots, and dill dip) 6 oz.; and Del Monte Vegetable Tray (containing broccoli, cauliflower, carrots, and dill dip) 12 oz.”

Cyclospora is a protozoan that causes severe gastroenteritis in humans called cyclosporiasis. Symptoms of cyclosporiasis include watery diarrhea, loss of appetite, cramping, nausea, fatigue, fever, dehydration and weight loss. Untreated, these symptoms can last several months or longer.
