Amini LLC Recovers Full Satisfaction of $52 Million Judgment Against Lynn Tilton

NEW YORK--()--In a landmark legal victory, Amini LLC announces the successful recovery of a full payment totaling $52 million, following its decisive judgment against Lynn Tilton on behalf of Trustee Salvatore LaMonica.

The case was navigated by the team at Amini LLC, led by Bijan Amini, Avery Samet, and Jeffrey Chubak, in close collaboration with the Trustee’s firm, Lamonica Herbst and Maniscalco, and the legal counsel of Carter Phillips and his team at Sidley Austin.

In June 2017, Mr. LaMonica, as Chapter 7 Trustee of TransCare, Lynn Tilton’s regional ambulance and paratransit company, engaged Amini LLC to investigate the circumstances surrounding TransCare’s bankruptcy filing. By February 2018, Amini brought suit against Tilton, the sole director of TransCare, and Tilton’s Patriarch Partners Administrative Services, LLC (“PPAS”), Transcare’s secured lender. The complaint alleged Tilton had used PPAS to orchestrate an insider sale of TransCare’s best assets to herself.

In July 2019, after prevailing on motion practice, Amini quickly brought the case to trial before the Honorable Stuart Bernstein, the bankruptcy judge overseeing TransCare’s estate. In July 2020, Judge Bernstein issued a decision determining that the insider sale constituted both a breach of fiduciary duty and a fraudulent transfer. Amini defended Judge Bernstein’s decision to the District Court (the Honorable Lewis Kaplan), who almost entirely affirmed Judge Bernstein in 2021. Amini then successfully obtained $13 million in pre-judgment interest.

Amini teamed with Carter Phillips at Sidley Austin to again defend the judgment before the Second Circuit, which affirmed the judgment 2-1 by decision dated August 28, 2023. To close the case, Amini moved by Order to Show Cause to compel payment on the bond.
