Christie Parker & Hale Secures Judgment and Permanent Injunction against Infringer of Master Cutlery’s Intellectual Property Rights

LOS ANGELES--()--Christie, Parker & Hale, LLP, an intellectual property law firm, recently secured a consent judgment and permanent injunction on behalf of its client Master Cutlery, Inc., the largest wholesale manufacturer of knife products in the United States. Lead counsel for Master Cutlery is Warren Bleeker, a Partner at Christie, Parker & Hale.

On May 14, 2015, United States District Court Judge John A. Kronstadt entered a Final Consent Judgment and Permanent Injunction against Pacific Solution Marketing, Inc. The Judgment confirmed the validity of four U.S. Copyright Registrations covering the designs of knife products created by Master Cutlery. Pacific Solution Marketing, Inc. sold products that infringed each Copyright. The Judgment also confirmed the validity of Master Cutlery’s federally registered trademarks of SHERIFF and EMT. Pacific Solution is now permanently enjoined from marketing, promoting, making or selling any product that is identical or substantially similar to any of Master Cutlery’s asserted copyrights or trademarks. Pacific Solution must also make a monetary payment to Master Cutlery of $120,000.

Victor Lee, President of Master Cutlery, commented: “Master Cutlery takes pride in its original designs and aggressively protects its intellectual property rights. We will take strong action to prevent unauthorized or improper use of our intellectual property rights.”

In a related matter, Judge Kronstadt dismissed with prejudice a claim asserted by Pacific Solution, that Master Cutlery had infringed a design patent. During the litigation, counsel for Master Cutlery uncovered facts that formed the basis for a claim of inequitable conduct against the inventor of Pacific Solution’s claimed design. Master Cutlery also sought a summary judgment ruling that its product does not infringe the claimed design. Following Judge Kronstadt’s tentative ruling of non-infringement in favor of Master Cutlery, Pacific Solution agreed to dismiss the case with prejudice.
