Before the final changes of the AIA came into effect on March 16, 2013, applicants rushed to file their patent applications as the new law included a number of provisions that made it more difficult to obtain protection in the United States.
The increase in applications that ensued is now affecting the number of applications up for PCT national stage entry review 30 months later. Patent applicants should expect an increase in filing numbers around 93% and 35% in September and October, respectively.
