DALLAS--(BUSINESS WIRE)--The national plaintiffs’ law firm of Baron & Budd today filed a class-action lawsuit representing plaintiffs from seven states, including: Texas, Colorado, Florida, Pennsylvania, Illinois, South Carolina and West Virginia. This is the first lawsuit to be filed against Lumber Liquidators in the state of Texas on behalf of homeowners who purchased formaldehyde-tainted flooring. The lawsuit was filed in the United States District Court for the Eastern District of Texas.
Baron & Budd’s lawsuit alleges that Lumber Liquidators falsely markets its laminate flooring products as safe when in fact many of its China-made products contain unsafe levels of formaldehyde. According to the American Cancer Society, formaldehyde is a known carcinogen that can foster the development of myeloid leukemia and nasopharyngeal cancer when people are exposed on a regular basis.
The homeowners allege that Lumber Liquidators knowingly sells laminate wood products that emit unlawfully high levels of the chemical, far exceeding emissions allowed by the California Air Resources Board (CARB). According to a 60 Minutes story aired on March 1, 2015, each sample of the Lumber Liquidators product tested in its investigations had formaldehyde emissions that were at least six times the amount allowed by CARB. The emissions from some of the samples were at least 20 times higher. Plaintiffs in the lawsuit allege that Lumber Liquidators further misrepresents the safety of its products by falsely labeling its laminate wood flooring products as being compliant with CARB’s formaldehyde emission standards.
Lumber Liquidators operated 352 stores in 46 states as of December 31, 2014 and had revenues exceeding $1 billion. The company advertises on its website that its products are “safe and meet the highest quality and environmental standards.” All plaintiffs purchased products from Lumber Liquidators’ “Dream Home” line of laminate flooring.
“We believe that Lumber Liquidators knowingly engaged in a scheme to increase profits by selling cheaper, but toxic flooring products to consumers,” said Scott Summy, head of the Environmental Group at Baron & Budd. “In addition, we believe the company materially misrepresents the safety of these products.”
