Pacific Coast Marine Windshield Wins Appeal in Patent Infringement Suit

VANCOUVER, British Columbia--()--Pacific Coast Marine Windshields (PCMW), a leading manufacturer of innovative windshield designs for recreational boats, announced today that it has prevailed before the Federal Circuit Court of Appeals in its patent infringement suit against Malibu Boats and other defendants.

The case involves allegations that the design used by Malibu on the majority of its windshields for the past several years infringes upon a design patent owned by Pacific Coast Marine Windshields, court documents state.

In May of 2012, PCMW calculated that it is entitled to an award of $87 million due to Malibu’s infringement, according to court filings.

“Pacific Coast Marine Windshields is pleased with the result in the court of appeals ruling and is looking forward to proceeding to trial on its patent infringement, copyright and other claims,” said Darren Bach, president and owner of PCMW.

According to the 2010 complaint filed in the US District Court for the Middle District of Florida, PCMW alleges that Malibu Boats is infringing PCMW’s design patent for its innovative windshield design. In addition, PCMW asserts that Malibu Boats has infringed PCMW’s copyrighted drawings and CAD files and misappropriated PCMW’s trade secrets concerning its proprietary manufacturing techniques.

“Malibu has enjoyed substantial sales of the alleged infringing design since May of 2012, so we expect that by the time of trial the amount we claim will be substantially higher,” said Bach.

Malibu Boats is a Loudon, Tennessee-based manufacturer of performance sports boats. On Dec. 13, 2013 Malibu Boats announced that it will seek to raise up to $115 million in an initial public offering, underwritten by Raymond James (NYSE: RJF) and Wells Fargo Securities, the investment banking division of Wells Fargo (NYSE:WFC), media reports state.

The Court of Appeals ruling was handed down Jan. 8, 2014 and is case number 13-1199.
