COLUMBUS, Ohio--(BUSINESS WIRE)--Thompson Hine partner Terrence M. One, a case involving a landfill owned by a Waste Management subsidiary, was in litigation for more than six years and included multiple weeks of fact and expert depositions, the production of more than 10 million documents, extensive discovery and dispositive motions practice, and a four-week trial. The final outcome for this long and complex litigation was positive for the client; the Ohio Environmental Review Appeals Commission upheld the Ohio Environmental Protection Agency’s approval of a permit tripling the amount of usable air space at the landfill, which will extend the site’s life by nearly 50 years – a huge benefit for Waste Management.

Fay also assisted Waste Management in defeating a complaint alleging that a landfill owned and operated by a Waste Management subsidiary had been constructed, designed and was being operated in a manner that endangered the public’s health and safety. Fay successfully argued the plaintiffs had failed to provide the notice of their intent to file suit as required by the federal Resource Conservation and Recovery Act.
These two big wins, combined with Fay’s knowledge of and experience in environmental law, earn his spot as one of five environmental lawyers honored nationally with the Law360 MVP title.
