In response, the Company announced efforts to increase and standardize portion sizes at its more than 3,600 restaurants. However, the Company subsequently disclosed that, as a result of those efforts, it expected cost of sales to increase to “just below 31%” in the third quarter of 2024.

Thereafter, the Company and certain of its executives were sued in a securities class action lawsuit, charging them with failing to disclose material information during the Class Period in violation of federal securities laws, which remains ongoing.
