HOUSTON--(BUSINESS WIRE)--Arrows Up, LLC has appealed the ruling in SandBox Logistics, LLC v. Arrows Up, LLC, No. 2016-03483 in the 334th Judicial District of Harris County. The company was the target of competition-stifling litigation by SandBox Logistics, a wholly-owned subsidiary of US Silica Holdings (NYSE-SLCA), and is seeking relief in the Texas Court of Appeals.
“We are convinced that this litigation is based on a contract that is an unenforceable restraint of trade. The action by SandBox and US Silica is and has always been about eliminating a competitor with a superior solution for the oil and gas industry,” said Kevin Shuba, CEO of Arrows Up managing affiliate OmniTRAX.
Arrows Up and its affiliate OmniTRAX Energy Solutions continue to expand their multi-basin operations and product innovations to meet their clients’ growing needs, including ShaleTECH Transportation, a recently announced joint venture that provides dramatic cost savings as part of a total sand transportation solution.
In addition to the Texas State Court appeal, Arrows Up continues its federal suit against SandBox to protect its first-in-time superior intellectual property rights.
