The complaint alleges that throughout the Class Period, American Renal issued false and misleading statements to investors and/or failed to disclose that: the Company was engaged in a fraudulent scheme to steer patients away from Medicare and Medicaid plans they qualified for, into more expensive Affordable Care Act plans to obtain greater reimbursement for its dialysis services; the scheme was in violation of federal and state laws; and as a result of the above, the Company’s public statements were materially false and misleading at all relevant times.
