Key U.S. Patent Win For TQ Delta

PTAB Denies 2Wire’s Six Petitions for Inter Partes Review

AUSTIN, Texas--()--TQ Delta LLC, a technology development and licensing firm, is pleased to announce that it successfully defeated six petitions by 2Wire, Inc., for inter partes review on patents related to multicarrier communications systems.

In six separate opinions dated May 29, 2015, the Patent Trial and Appeal Board (PTAB) found that petitioner 2Wire had not demonstrated a reasonable likelihood that any challenged claim of the six patents was unpatentable based on the asserted grounds. Therefore, the judges did not institute an inter partes review as to any of the challenged claims. The six patents are U.S. Patent Nos.: 7,292,627; 7,471,721; 8,090,008; 8,073,041; 8,218,610; and 8,355,427.

“We strongly believed that 2Wire’s arguments failed to prove that our valuable inventions were obvious, and we are happy that the Patent Office agreed,” said Abha Divine, Managing Director of TQ Delta. “These decisions further demonstrate the high quality of our patented inventions, which we believe represent important, foundational IP for the communications industry.”

TQ Delta is represented by the law firm of McAndrews, Held & Malloy. “TQ Delta is very pleased that the PTAB vindicated its position and refused to institute inter partes review on any of the six patents challenged by 2Wire,” said Peter McAndrews, TQ Delta’s lead counsel. “This is an important decision for patent owners. It puts teeth in the requirement that petitioners articulate a sufficient reason to combine disparate prior art references. If followed by other panels, it may dampen the high rate of IPR institution by the PTAB.”

The challenged patents are part of TQ Delta’s portfolio of more than 100 U.S. and foreign patents that are applicable to communications technologies, including Digital Subscriber Line (DSL). “This portfolio has a deep history and we continue to invest in developing it to solve current and emerging technological challenges,” said Divine.
