Polycom is Committed to Protecting its Valuable Intellectual Property, Files Copyright Infringement Claims Against Xiao Yu Yi Lian (“Little Fish”)

BEIJING--()--Polycom, Inc., an industry leader in enterprise grade business communication solutions, filed a software copyright infringement case with the Beijing Intellectual Property Court against Little Fish. The claim, accepted by the court asserts that the defendant’s Xiao Yu Yi Lian M80 product and Android app infringe on Polycom’s copyrights found in its RealPresence Desktop and RealPresence Mobile products.

“It is our goal for this lawsuit to send a clear message that Polycom takes the protection of our valuable intellectual property very seriously and we will not sit on the sidelines when individuals or companies violate it,” said Mike Mills, Polycom’s Senior Vice President and General Counsel.

Polycom will seek all remedies it has available to it, including compelling Little Fish to hand over its source code to the Tribunal, immediate cessation of the manufacturing and selling of the infringing products, public acknowledgment and announcement on multiple public media platforms of its wrongful infringement and significant monetary damages in the amount of 100M RMB.

There is no doubt that Little Fish’s actions have violated the “Copyright Law of the People’s Republic of China” and the “Computer Software Protection Regulations” and the severity of the infringement is clearly established by the evidence submitted to the Tribunal. Both the server and end user side of its M80 product infringe on Polycom’s RealPresence Desktop and RealPresence Mobile products by copying its source code. The infringement is evidenced in Little Fish’s software structure, network communication protocol, call session module, software function name, and software code. Even more egregiously, Little Fish directly copied Polycom’s security certificate and used it in its Android mobile app.
