FLAGSTAFF, Ariz.--(BUSINESS WIRE)--Pritzker Hageman, P.A., a national food safety law firm, has filed a lawsuit against The SoyNut Butter Company, based in Glevnview, Illinois, for alleged E. coli contamination of the company’s I.M. Healthy SoyNut Butter. Attorneys Brendan Flaherty and Ryan Osterholm, along with local counsel, filed the suit on March 23, 2017, in the United Stated District Court Northern District of Illinois (Case : 1:17-cv-02233).
The lawsuit was filed on behalf of a minor child, M.R., and her parents, residents of Coconino County, Arizona. Documents filed with the court allege M.R. contracted a nearly-fatal E. coli O157:H7 infection after eating I.M. Healthy SoyNut Butter at a daycare in Flagstaff, and that he is part of the multistate outbreak that has sickened at least 23 people in 9 states, most of them children. M.R. is one of 7 outbreak patients who was hospitalized with a severe complication called hemolytic uremic syndrome (HUS), a life-threatening and life-altering disease of the kidneys.
“Our young client fought for his life, and he now has permanent kidney damage,” said Brendan Flaherty, one of the lawyers representing the family.
The parents of M.R. are also named as plaintiffs.
“The parents of a child who has HUS have been through hell,” said attorney Flaherty. “There is no way to describe how hard it is to see your child in the ICU and be told by world-class doctors that there is no cure and little they can do.”
The outbreak linked to I.M. Healthy SoyNut products has sickened people in the following states: Arizona (4), California (5), Maryland (1), Missouri (1), New Jersey (1), Oregon (6), Virginia (2), Washington (2), and Wisconsin (1), according to the most recent report from the Centers for Disease Control and Prevention (CDC).
