AHF: Measure B Condom Requirement is Now “…Settled Law,” after L.A. County, Porn Industry Reach Legal Settlement

Los Angeles County Supervisors reach formal settlement with Vivid Entertainment, Califa Productions & others in lawsuit seeking to block implementation of Measure B, the 2012 ballot measure approved by 57% of Los Angeles County voters that requires porn actors to wear condoms.

LOS ANGELES--()--AIDS Healthcare Foundation (AHF), the proponent and principal funder of Measure B, the “County of Los Angeles Safer Sex in the Adult Film Industry Act,” that requires actors in pornographic films to wear condoms, issued the following statement from AHF President Michael Weinstein regarding settlement of a lawsuit earlier today against L.A. County by several porn industry producers who sought to block implementation of the law.

“The constitutionality of the condom requirement is now settled law, which is a monumental accomplishment. No producer can any longer claim that if they film without condoms in Los Angeles County that they don't know that they are breaking the law. Now the County will be required to do a fee study to come up with a revenue neutral fee for their health permit. While certain provisions of Measure B were overturned, such as surprise inspections and denying future permits to past violators, the road is now clear for L.A. County to fully enforce the law.”

Los Angeles County’s “condoms in porn” measure was voted into law November 2012 with an overwhelming margin of voter support (57% to 43%). On January 10, 2013, Vivid’s Steve Hirsch and others in the industry sued Los Angeles County to block implementation and roll out of the law. However, during the course of litigation, both the U.S. Ninth District Court and the U.S. Ninth District Court of Appeals upheld Measure B, with each court ruling that requiring condom use in adult film productions does not infringe on the industry’s First Amendment rights. After the adult industry declined to continue with the lawsuit, the Los Angeles County Board of Supervisors voted to settle the lawsuit in a legal settlement that was finalized today.

The lawsuit, Case No. CV-13-00190 DDP (AGI), was filed with Steve Hirsch’s Vivid Entertainment and Califa Productions as lead plaintiffs, and named County of Los Angeles, Dr. Jonathan Fielding, Director of the Los Angeles County Department of Public Health, and County District Attorney Jackie Lacey as Defendants.
