Savi Responds to Unwarranted EEOC Claim

ALEXANDRIA, Va.--()--On August 7, 2014 the Equal Employment Opportunity Commission (EEOC) issued a press release stating that it had sued Savi Technology for pregnancy discrimination in violation of Title VII of the Civil Rights Act of 1964. While it is generally Savi’s policy not to comment publicly on legal matters, in this case the EEOC has misrepresented events, and the allegations in its press release omitted several key facts. Most notably, the release claimed that Savi rescinded a job offer upon discovery that an applicant recently had given birth. In fact, Savi was fully aware that the applicant had recently given birth prior to the company extending the job offer, and the decision to rescind the offer had absolutely nothing to do with the applicant’s gender, the fact that she had recently given birth, or her medical condition. Instead, the decision was based solely on the fact that the applicant formally rejected Savi’s offer of employment by countering with new and materially different terms, unrelated to her gender or medical condition, that Savi found unacceptable given the company’s legitimate business requirements at the time. As a result, Savi decided to reject the applicant’s counter-offer and rescind its original offer.

Savi is confident that it has complied with all applicable laws, rules, and regulations in the handling of this matter. To be clear, Savi supports the overall mission of the EEOC and disavows discrimination of any kind. Savi believes that in this case the EEOC is improperly substituting its judgment for the legitimate, non-discriminatory business judgment of an employer in violation of well-established legal precedent. For example, in EEOC v. The Picture People, Inc., the court held that “a Court should be hesitant in displacing the judgment of an employer on how to run its business.” Savi’s decision to rescind the offer in this matter was based solely on Savi’s legitimate, non-discriminatory business needs.

Savi is extremely proud of its employee and family-friendly culture and policies. Savi values diversity and does not engage in, nor tolerate, discrimination in any form as a matter of principle as well as a matter of regulatory compliance. Savi is disappointed that the EEOC chose to take this action, but Savi looks forward to vindicating its rights in a court of law.

With this release, Savi will have no further public comment on this matter until the legal proceedings have concluded.
