LOS ANGELES--(BUSINESS WIRE)--Greenberg Glusker client Toho Co. Ltd, the owner of the world famous characters Godzilla, Mothra, and Rodan, among many others, announced today that it has resolved its copyright and trademark dispute with New Orleans Lager & Ale Brewing Co. concerning the unauthorized use of Toho’s Mechagodzilla character.
“It is unfortunate that so many seek to commercially exploit Toho’s intellectual property without authorization,” said Greenberg Glusker intellectual property litigator Charles Shephard, who has served as counsel to Toho for over two decades. “Toho will continue to take appropriate legal action against those who do.”
Toho sued the brewery last year when it began distributing a beer called Mechahopzilla, which featured a character strikingly similar in appearance to Toho’s character. Pursuant to the settlement, the brewery will rename its beer and change the character image by the end of the year. Any new name and character image will require Toho’s consent. Further, as part of the settlement, the brewery has withdrawn its attempt to register Mechahopzilla as a trademark.
“Toho vigorously protects Godzilla and its other characters because they are extremely valuable,” said Greenberg Glusker intellectual litigator Aaron Moss. “The incredible box office results of Legendary’s new Godzilla film leave no doubt about this.”
Toho has filed numerous lawsuits against infringers of its famous Godzilla character. This is the first time Toho has filed to prevent the authorized exploitation of Godzilla’s mechanical counterpart, Mechagodzilla.
Legendary’s Godzilla re-boot, licensed by Toho, has generated gross revenue of more than $375,000,000 worldwide in less than three weeks.
