U.S. District Court Finds in Favor of Azbil BioVigilant in Patent Litigation Dispute

TUCSON, Ariz.--()--Azbil BioVigilant, Inc. (www.biovigilant.com), inventors of Instantaneous Microbial Detection™, announced today that the U.S. District Court for the District of Arizona dismissed the patent infringement lawsuit brought by TSI against the Company. In doing so, the Court found in Azbil BioVigilant’s favor, holding that U.S. Patent No. 6,831,279 is invalid.

The Court’s dismissal follows a ruling reached by the U.S. Patent and Trademark Office earlier this year where, for a third time, it rejected TSI’s arguments in the reexamination and found that TSI’s patent is not patentable.
