LOS ANGELES--(BUSINESS WIRE)--LibertyBell Law Group’s federal lawyer, Gina Tennen, and team of criminal lawyers obtained a not guilty verdict for a high-profile client employed by San Jose County. The penalty could have been 15 years in federal prison. The federal case, involving fraud, theft, and conspiracy, was deliberated over in a trial by jury. Case No. 3:12-cr-00483-EMC.
The defendants were Public Administrators of deceased persons’ estates not having wills or an executor to distribute assets among heirs. The estates in care valued in the millions of dollars on a daily basis. Many of the estates included apartments and houses in Paris and New York, Rolex watches, bank accounts, boats, cars, planes, antique jewelry, valuable collectibles, and art.
The defendants were accused of leading a conspiracy fraught with fraud and theft from the estates. Search warrants were executed on both defendants and a ravage search was conducted on the client’s home.
LibertyBell Law Group’s criminal and federal lawyers conducted their own investigation of the circumstances and witnesses surrounding the case. The lawyers noted how much the County Probate office was in disarray and lacking in procedural policies. Only two deputy public administrators were employed to do all probate work for the entire county, which were the defendants in this federal case. Both had a massive, almost unmanageable case load.
The federal lawyers argued that during the search in the client’s home, law enforcement deemed personal valuables as having been stolen. They assumed the client could not possibly own anything of worth. The 55 year old client had worked at Macy’s prior to becoming employed by the state; surely she would have gotten a hefty discount on many valuable items. The defendants were also accused of fraudulent pretenses, attempting to impersonate a deceased, and mail fraud.
