OLDWICK, N.J.--(BUSINESS WIRE)--In this A.M. BestTV episode, members of the National Risk Retention Association discuss efforts to achieve a consistent application of the federal Liability Risk Retention Act across the United States, due to instances where they say state regulators have usurped aspects of the law. Recently, NRRA has adopted an amicus strategy, which has resulted in several favorable court decisions. Skip Myers, general counsel at the NRRA, said that over time, "the protections tend to get eroded by some of the regulatory interpretation." Jon Harkavy, general counsel at Risk Services, LLC, also noted that there isn't much precedent for justices to fall back on, and so the strategy is also about education and building case law for future litigation. Another avenue the NRRA has taken is working directly with Congress. Rod Nofziger, vice chairman of the NRRA, spoke about legislative efforts to build a federal dispute resolution mechanism, with another piece to extend the federal act so that groups could write property along with liability products.
