JACKSONVILLE, Fla.--(BUSINESS WIRE)--Glancy Binkow & Goldberg LLP filed a class action complaint in federal court against Goodman Manufacturing Company. L.P. and Goodman Global, Inc. (“Goodman” or the “Company”) related to the Company’s alleged defective air conditioning units. Specifically, the complaint alleges that Goodman’s air conditioning units contain defective evaporator coils that leak causing the units to stop functioning properly. Consequently, Goodman customers have paid thousands of dollars in repair costs. The complaint alleges that Goodman breached its express warranty and is engaging in unfair and deceptive trade practices in connection with the manufacture and sale of its air conditioning units.
On August 28, 2013, the Court issued an Order denying, in part, Goodman’s Motion to dismiss the complaint. In that Order, the Court concluded that “Plaintiff has [ ] plausibly alleged that Defendants’ warranty limitations were unconscionable, and on this basis alone this Court will deny the Motion to dismiss as to Plaintiff’s express warranty claim.”
