S. Magistrate hearing the patent infringement case brought by Relion in 2006, will grant Relion’s request for dismissal subject to Relion agreeing to restrictions on suing Hydra on the patent in question, Relion must return sanction funds previously taken from Hydra and Relion must reimburse Hydra’s costs of the suit. The judge stated in his ruling “…it is difficult to view Relion’s motion to dismiss ‘as anything other than an eleventh-hour attempt to pull the jurisdictional rug out from under a counterclaim that it could not defend against on the merits’.”
