BEDFORD, Mass.--()--Medica Corporation, a manufacturer and worldwide distributor of in vitro diagnostic medical devices, announced today that it has settled its lawsuit against Diamond Diagnostics Inc. of Holliston, Massachusetts. Terms of the settlement include payment of damages by Diamond for past wrongdoing and Diamond’s agreement to the entry of a permanent injunction by the Federal District Court in Boston. Diamond has agreed to make payment by December 31, 2009.
Medica brought suit to enjoin Diamond from selling its Prolyte Electrolyte Analyzer with Medica’s proprietary EasyLyte® software (Medica vs. Diamond Diagnostics Inc., Civil Action #1:09-CV-10839-JLT). In its complaint, Medica alleged that Diamond pirated Medica’s proprietary EasyLyte® software by illicitly copying and incorporating it into their Prolyte Electrolyte Analyzer. Medica had sold more than 30,000 EasyLyte® Electrolyte Analyzers worldwide before Diamond began selling the Prolyte Analyzer in 2007 with Medica’s EasyLyte® operating and printer software.
On November 22, 2009, the Federal Court issued a permanent injunction prohibiting Diamond Diagnostics, its officers, employees, and others in active concert or participation with them, from selling the Diamond Prolyte with Medica’s proprietary operating and printer software. The Court also permanently enjoined Diamond from distributing the Prolyte Operator’s Manual containing any text, drawings, and illustrations developed by Medica. The Federal Court in Boston has retained jurisdiction over Diamond to enforce the injunction.
